Child Solicitation-Enticing in New Jersey
The crimes referred to as Luring, Enticing, or Solicitation of a Minor are all the same crime and are codified in the New Jersey State law under the same statute. A person commits Luring if he:
Attempts, via electronic or any other means, to lure or entice a child or one who he reasonably believes to be a child into a motor vehicle, structure or isolated area, or to meet or appear at any other place, with a purpose to commit a criminal offense with or against the child.
Important Points
As you can see from the definition of the crime, in order to be convicted, you must attempt to lure the child to a place with the purpose of committing a criminal offense once there.
Thus, you cannot be convicted of this crime for only conversing with a child over the internet.
Additionally, you must have the intent to commit a crime with the child once the meeting occurs. Therefore, if you are simply meeting the child for coffee or for some other non-criminal reason, it is also not a crime under this statute.
Penalties if Convicted
The penalties for Luring are severe and are even more severe if you have been previously convicted of the crime.
First Offense: Second Degree Crime, results in 5-10 years in prison and fines.
Second or Subsequent Offense: Second Degree Crime, results in 5-10 years in prison; AND You must serve a minimum term of one-third to one-half of the sentence imposed, or three years, whichever is greater, and you are not eligible for parole during that time period.
