Solicitation of a Minor Defense Lawyer

Luring, ‘Enticing a Child’ or ‘Solicitation of a Minor’ is a crime that commonly occurs over the internet, and can carry serious penalties if a conviction results.  Even if you know that the person you are speaking with is an adult, if that person represents themselves over the internet as a minor, you can be charged under this law.  Like all sex related offenses, particularly those that relate to minors, the mere accusation of this type of crime can carry an extraordinarily strong social stigma that may follow you for the rest of your life.

My name is Anthony N. Palumbo, New Jersey Solicitation and Luring Defense Attorney with over 35 years of experience and if you have been charged with solicitation in New Jersey, I can assist you.  In cases involving incriminating evidence over the internet, it is particularly important for you to contact an attorney immediately, even if you are only under suspicion of a crime and have not been formerly charged. Our firm represents clients throughout New Jersey including Bergen County, Hudson County, Middlesex County, Somerset County, Essex County, Ocean County, and Union County.

Child Solicitation-Enticing in New Jersey

The crimes referred to as Luring, Enticing, or Solicitation of a Minor are all the same crime and are codified in the New Jersey State law under the same statute.  A person commits Luring if he:

Attempts, via electronic or any other means, to lure or entice a child or one who he reasonably believes to be a child into a motor vehicle, structure or isolated area, or to meet or appear at any other place, with a purpose to commit a criminal offense with or against the child.

Important Points

As you can see from the definition of the crime, in order to be convicted, you must attempt to   lure the child to a place with the purpose of committing a criminal offense once there.

Thus, you cannot be convicted of this crime for only conversing with a child over the internet.

Additionally, you must have the intent to commit a crime with the child once the meeting occurs.  Therefore, if you are simply meeting the child for coffee or for some other non-criminal reason, it is also not a crime under this statute.

Penalties if Convicted

The penalties for Luring are severe and are even more severe if you have been previously convicted of the crime.

First Offense: Second Degree Crime, results in 5-10 years in prison and fines.

Second or Subsequent Offense: Second Degree Crime, results in 5-10 years in prison; AND You must serve a minimum term of one-third to one-half of the sentence imposed, or three years, whichever is greater, and you are not eligible for parole during that time period.

Police Sting Operation

It is common for police to surf the web or enter chat rooms as minors in order to entice individuals to commit crimes.  If you have been tricked into believing an officer was really a minor, the prosecution must prove that you had the intent to solicit a minor, not an adult police officer.  An experienced internet crimes attorney may be able to show that you did not have the proper intent, and thereby have the charges against you dismissed.  This is just one reason why it is so important to have an experienced internet defense attorney by your side.

Don’t wait until incriminating evidence is collected against you to contact an attorney.  If you even suspect that you are under surveillance for Luring or Solicitation of a minor in New Jersey, contact an experienced New Jersey Luring Defense Attorney today.  In these types of cases, it is imperative to retain an attorney as soon as possible to prevent the accumulation of evidence that may be fatal to your case.
